The <br />first issue is to request further clarification of the Inspection Report <br />summarizing the inspection of the H-G mine on October 14-16, 1987. In <br />particular we would like further clarification of the results of the <br />topsoil survey. As we discussed, we feel that since the Division could <br />only drill to a depth of 24 inches, the statement that "the average depth <br />was 21.75 inches" would be based on a biased sampling technique. We <br />believe the Division's depth sampling results are not entirely <br />representative of the topsoil deaths at the mine. <br />The second issue involves a commitment by the Division based on <br />this and past field surveys that the replaced topsoil depth meets the <br />requirements of the reclamation plan. This commitment would be in the <br />context of the necessary partia] bond release requirements. Although we do <br />not request any specific topsoil related reduction in the bond at this <br />time, a determination by the Division that replaced topsoil depths are <br />adequate will hasten the release of the mine operator's obligations in this <br />issue. <br />
