Cattany <br />Division Dileaor <br />Natural Resource Truseee <br />Dear Mr. Addison, <br />Listed below aze adequacy review comments on the Lilly Mines 112 Conversion Application, Permit <br />Number M-1987-028. The Division of Minerals and Geology (Division) is required to make an approval <br />or denial decision no later than May 19, 2006, therefore, your response to the following adequacy review <br />concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice circulated <br />in the local newspaper, all owners of record of surface and mineral lands, easement holders, and <br />owners of record of surface lands that are within 200 feet of the boundary of the affected land. Proof <br />of notice may be return receipts of a Certified Mailing or by proof of personal service. <br />2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or <br />other qualified person. The maps submitted to the Division were not signed. Please resubmit a <br />signed copy of the maps. <br />3. The applicant submitted the CN-Ol application as Colorado Marble, Inc. However, the permit is held <br />by Colorado Mazble, LLC. If the applicant desires to change the operator name to Colorado Mazble, <br />Inc., then the permit must be transferred prior to approval of the CN-Ol application. The forms <br />required to transfer a permit can be located at the Division's web page at httD://mininQ.state.co.us/. If <br />the applicant intends to keep the company name of Colorado Mazble, LLC, then the permit <br />application and associated documents must be changed. Please respond accordingly. <br />Rule 6.4.3 Exhibit C- Pre-Mining and Mining Plan MaQs <br />4. Per Rule 6.4.3(g), the applicant will need to depict the owner's name, type of structure and location of <br />all significant, valuable and permanent man-made structures on the area of affected land and within <br />200 feet of the affected land. Please identify the owners of all structures on and within 200 feet of the <br />affected land. This would include roads, ditches, pipelines, gas lines, gas wells, utility lines, water <br />wells and historic mining structures adjacent to the mining azea and staging area along Highway 50. <br />5. The operator states that collection and diversion of all surface water flows into the mazble pit from <br />former underground metal mining operations located above the marble mine zone will help mitigate <br />any potential for low pH water that might be a source from old metal mine workings.
