In addition to the responses proposed as required under Rule 4.20.3 (cleanup, etc.), I suggest we look into <br />the requirements of 2.06.6. We have evidence that rockfalls can be expected from outcrops in steep terrain as a result of <br />subsidence. Perhaps the areas subject to rockfall runout should be identified, under Rule 2.05.6(6)((e)(i)(F)(IV), such <br />runouts being a related phenomena. Certainly, such areas should probably be within the permit area, and the subsidence <br />control plan have elements in it to protect the public (and mine employees) under Rule 2.05.6(6)(f)(iii)(C)(iv). Under Rule <br />2.05.6(6)(f)(iii)(C)(V), we might require monitoring stations to determine when the potential for such rockfalls might <br />diminish, such as a finding that subsidence has occurred and has arrested in such areas. Once these surface areas come <br />within the angle of draw of underground extraction, and until subsidence has been effected, such areas could be closed to <br />surface access. The rock slide was <br />probably a result of subsidence from the east side of the northernmost longwall panel of Bowie <br />No. 2. The rock debris has closed the road up Hubbard Creek Canyon and it looks like some of <br />the rock may have reached Hubbard Creek. The Forest Service wants Bowie Resources to post a <br />sign that says that the road is closed. The Forest Service also wants Bowie to clear the road in <br />the Spring. They are assuming that the field conditions are not right for a cleanup operation now. <br />The DMG will get Bowie to commit to this and to revise their permit application to include <br />mitigation procedures for road damage due to rock slides.
