Sox 161 Div is ionDueao~ <br />Silt, CO 81652 ' <br />RE: Water Qse Issues <br />Eastside Mine (C-84-063) <br />Dear Mr. Self: <br />In the process of reviewing Eastside's application for a permit <br />renewal, the Division is required to notify other Federal and State <br />agencies of the pending renewal and request input from them <br />regarding the permit. Among the agencies contacted was the US Fish <br />and Wildlife Service (USFWS). The USFWS has expressed a concern <br />regarding consumptive water use and has requested a Net Depletion <br />Report prior to the approval of the permit renewal. <br />The report, which will be prepared by the Division, needs to <br />document the total use of water by the Eastside Mine (surface and <br />mine water) and provide calculations for how much the water use <br />represents as a net depletion to the upper Colorado River. Once <br />the report is submitted, the USFWS can determine if the depletion <br />impacts any endangered or threatened species. For the Division to <br />calculate the net depletion, Eastside should submit a revision to <br />the permit on the augmentation plan approved by the Division of <br />Water Resources last year. <br />Please submit the requested information as soon as possible, as the <br />permit renewal deadline is only a couple of months away.
