CONVERSATION RECORD
Date: .May 16, 2000
Call From:
Call To:
Subject:
Sandy Vana-Miller, Wildlife Biologist, PSD, OSM, Denver, CO, 303-844-14W
Terry Ireland, USFWS -Western Colorado Office, Gland Iunction, CO, 970-243-
2778 x1G
Compliance with the Endangered Species Act (ESA) for RAG Twentymile Coal
Compsny's Foidel Creek Mine, Mining Plan Modification
1 called Terry Ireland, Biologist, to discuss the proposed mining plan modification for extending
mining operations into the remainder of Federal coal to lease COC-54608. Located in Routt
County, Colorado, the proposed operation would be a typical long wall underground mine. i
explained that there would be nu change in production rate and no additional surface disturbance
as a result of the proposed modi fication.
Based on this information, Teny concurred with my determination that the proposed Foidel
Creek Mine -Mining Plan Modification would have no effect on threatened or endangered
specics or their critical habitat. In accordance with the 1996 Biological Opinion and Conference
Report from the USFWS to OSM on Surface Coal Mining and Reclamation Operations under
SMCRA of 1977, Teny stated that no further discussion (including species-specific protective
measures) was necessary at this time. However, OSM and Ote Regularity Authority should
contact the USFWS if there are changes to the operation that would change the annual water
depletion or poterrtially affect listed or proposed spc:cics or their critical habitat.
~~~~ ~~
(Signature)
s ~~ o~
(Date)
v
D .10 ~ 24Ah1 :
