Walther
Executive Director
Ronald W. Cattany
Division Director
In your response to the Division's first adequacy letter, you provided specific acreages For each
activity within the'100-acre phased operation. rather than. outline the various phases or outline the ....
order in which each phase would be mined so you. need to provide a detailed description how :.
you plan to clearly delineate the areas in the field so the DMG can easily identify each activity,
and all allocated acreage, during normal inspection trips. Also, in order to verify that you.have
not exceeded the approved size.of each phase, you will need to show all the disturbed acreage
(and the size of each area) on a map that must be submitted with each annual report..
Of additional concern is. your commitment to maintain a 200-foot setback from all: the structures:.. ,
or provide a notazized agreement with thestructure owner or submit an engineering evaluation
pursuant to requirements of Rule 6.4.19 (not Rule 6.4.1(a)). 100 feet from either side o£the .
centerline does not equal a 200-foot setback. The affected land (which involves the entire pemut
azeaj must set back 200 feet from the man-made structure: This would involve a setback of 200
feet from the edge of the canal, not 100 feet from the centerline.
Your response will not be considered a technical revision or an amendment to the application so
you are not required to file a copy with the Clerk and Recorder.
If you have any questions, please give me a call at 303-866-4060.
Sincerely,
James Dillie
Environmental Protection Specialist
cc: Harry Posey (e-mail)
