Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received Technical Revision (TR-08) for the Lyons Quarry, Permit No. M-1977-208 operated by <br />CEMEX, Inc. The revision requests a hydrogeologic investigation at C-Pit and to install a compliance well <br />down gradient and to the east of C-Pit. The Division has the following questions that will need to be addressed <br />prior to approval of the revision: <br />1. The Division believes that an upstream ground water sampling location should be considered to <br />establish and further understand the upstream ground water parameters of the C-Pit. Please address <br />the-need of establishing an upstream monitoring well and a sampling plan to establish baseline water <br />quantity and quality. <br />2. The operator proposes a number of piezometers and monitoring wells. Please describe how the wells <br />will be reclaimed and include a reclamation cost estimate for abandonment of the wells. <br />3. The operator states that the data from the first phase of work will be used to refine the current <br />conceptual model for the C-pit azea, which will be used as the basis for a proposed long-term <br />monitoring program for the C-Pit. Please inform the Division as to the timing of the submittal of a <br />long-term monitoring plan. <br />4. The operator provided a table for a single round of sampling proposed in this initial phase. Please <br />further explain the frequency of the sampling necessary in order to assess the hydrogeologic conditions <br />at the C-Pit. In addition, please clarify the sampling frequency and pazameters to be analyzed for <br />CEM-005. <br />Please be advised that Division's decision due date is set for May 13, 2007. If you feel more time is needed to <br />complete your reply, the Division can grant an extension to the decision date. This will be done upon receipt <br />of a written waiver of your right to a decision by May 13, 2007 and request for additional time. This must be <br />received no later than the deadline date.
