As per Rule 2.08.5(2)(a), Seneca Coal Company <br />filed a complete application for renewal of the permit on August <br />19, 1996. A 60-day extension was requested on February 14th <br />moving the decision deadline to April 18th. <br />Based on our phone conversation of April 3rd, Seneca will waive <br />this date and ask for an additional 30-day extension of the <br />deadline to May 18th. This will allow the Division to review what <br />has been submitted based on the adequacy concerns we addressed. <br />This will also give us time to see if the personnel in our St. <br />Louis corporate office will have completed the ownership and <br />control information updates based on the demerger of Hanson, PLC <br />and Peabody Holding Company, Inc. into The Energy Group, PLC. <br />Should you or any other members of the Division have any <br />questions regarding this information, please do not hesitate to <br />contact me. <br />Sincerely, <br />Michael G.
