iii iiiiuiiiiiii iii 999 NOTICE OF PROPOSED DECISION The Colorado Division of Minerals and Geology proposes to approve Technical Revision Application No. 48 (TR-48) for the Colo~ryo Coal Mine (Permit No. C-81-019), submitted by Colowyo Coal Company L. P. This proposed technical revision provides for increasing the size of the West Pit box cut from 40 to approximately 45 million cubic yards and revising post-mining topography of the West Pit fill. The revision to the post-mining topography of the fill allows for reducing the steepness of west facing slopes of areas near the fill (towards the East Taylor drainage), and the placement of an additional 3,960,000 (to that already permitted) loose cubic yazds of spoil from mining activities in the West Pit. The revision includes slight rerouting and steepening of a permanent drainage off the reclaimed fill and steepening of approximately 1500 feet of the intermittent East Taylor drainage from that currently permitted in the reclamation plan. The revision expands the footprint of the spoil pile by approximately 11 acres onto adjacent areas previously approved for disturbance. The Colowyo Coa] Mine is a surface coal mine located in Moffat County, approximately 28 miles south of Craig. Coal interest is federal, and the surface affected is federal, state and private land. The permit azea encompasses approximately 7,402.5 acres. This proposed decision is based on a fording that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S.. and the regulations promulgated thereunder. Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado Division of Minerals and Geology, Room 215, Centennial Building. 1313 Sherman Street, Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made within ten (10) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the proposed decision.
