RE: Adequacy Review, Technical Revision No. 1, Two Rivers Pit, P ermit No. M-1998-038
Deaz Mr. Kirkland:
The Division has completed its initial review of your proposed Technical Revision No. 1. We have an
adequacy issue with the proposal. Please satisfactorily address the following item prior to the May 10,
2000 decision due date. If you cannot address this issue prior to that date, you should request a
continuation of the decision to a later date to avoid denial of the revision.
Your Technical Revision No. 1 is not consistent with the approved mining plan. Your
approved plan is a phased mining operation, which would require that one phase be mined and
reclamation started prior to starting mining in the next phase. The 15 acres you propose to
mine under this revision is in parts of two phases, Phase l and 2. You must include as part of
this revision a restructuring of your phased mining plan. You should redraw the phase
boundazies. In this case you would probably want to add that portion of the 15 acres in Phase 2
to Phase 1. You may want to add unmined Phase 1 acres to Phase 2 to keep the acreage in
balance, but this is not required.
If your response does not change the amount of acreage you want to add [o the present phase of
mining, your bond would be increased by a per acre amount. ($150,643 present bond amount divided
by 40 acres presently allowed disturbance area = $3,766.00 per acre.)
