The DMG requested that Bear respond to the DMG's adequacy letter dated <br />August 20, 2004, for the Phase One Bond Release. Following are Bear's responses to <br />the DMG's August 20, 2004 letter: <br />Enclosed is a letter dated January 25, 2005, from Oxbow Mining, LLC, that <br />addresses the frame building. Oxbow requested that the build be razed and the <br />single power pole located near the building be removed. A copy of the letter is <br />attached. Although the frame building and power pole will be removed, it is <br />Bear's intention to maintain the limited residential post mining land use. Items to <br />be maintained to support the limited residential post mining land use include the <br />paved road, bridge, fence and flood protection berm. <br />2. Bear is working with Arch and Oxbow to work out right-of-entry. There is no <br />concern about right of entry to support the post mining land use of limited <br />residential land use. Bear and Oxbow have already entered into a Limited <br />Access and Surface Use Agreement. Bear expects to have aright-of-entry <br />agreement with Arch in the near future. Bear is currently working with Jan <br />Wooton, (Arch) 314-994-2944. The right-of-entry documents will be incorporated <br />into the permit as soon as Bear finalizes its agreement with Arch. <br />3. The request to have Gunnison County approve of the retention of the mine office <br />as a residence should no longer be applicable since the frame building is to be <br />razed. <br />4. The 10 pieces of rebar sticking out of the ground in the area just west of the <br />reclaimed exhaust fan portal will be removed as soon as weather permits. <br />
