Based on a recent conversion, the Preliminary <br />Adequacy Review (PAR) issues are shorter than normal. As noted in an early correspondence the <br />tentative Decision Date is January 24th, 2006. Please clarify or correct the following issues: <br />1) On the Mining Map a noted feature is the Spring Creek Ditch. The Ditch is not noted as a <br />permanent structure in Exhibit S. Please clarify who owns the ditch /right-of--way. If the ditch <br />is owned by anybody but Mr. Gray, a damage agreement or engineering statement must be <br />supplied and listed in Exhibit S. Also if owned or right-of--way is someone else, proper notice <br />must be served to them. <br />2) Please change text in the Mining Plan to reflect new access point. <br />3) Within the Reclamation Standards, Rule 3, it is noted that all fuel storage is limited to self- <br />contained units. However, a previous inspection noted a fuel tank on site. Please clarify, will <br />there be any storage of fuels on site and if so, describe in detail secondary containment measures. <br />4) The Reclamation Plan notes concurrent reclamation to limit liability. However, the 3.1.3 text <br />notes that all proposed disturbed acreage will be affected and reclamation done upon completion. <br />Please clarify in detail how the 6 acres will be reclaimed prior to the 5.3 acres being disturbed. If <br />concurrent reclamation cannot be accomplished, then the bond will reflect the total acreage and <br />the permitee may request a partial bond reduction upon full reclamation of the purposed 6 acres. <br />5) Please submit for the file a copy of the approved Montrose County Weed Control Plan. <br />6) Staff is requesting a copy the required public notice and notification of the final day for <br />comments to be received. <br />Staff has received the requested new maps, documentation of County SUP work and response to OSE <br />concerns.
