We are also in favor of controlled gravel extraction within the <br />Uncompahgre River to remove the excessive channel aggradation. However, this request will <br />need to be presented before the Mined Land Reclamation Board during the April 27-28 Board <br />Meeting due to the issue of offsite impacts. Section 116(71(hl of the Colorado Mined Land <br />Reclamation Act 34-32-101 ei seq., 1973 states, "areas outside of the affected land shall be <br />protected from slides or damage occurring during the mining operation and reclamation." We <br />feel the Board's concurrence is necessary in this case even though the projected long-term <br />impacts to the river system will be beneficial. Therefore, we suggest that you waive your right <br />to a decision on the application within the 30-day time frame so that we can secure the Board's <br />approval. <br />We request that you provide a confirmation letter from the Corps of Engineers prior to the <br />April 27-28 Board Meeting. Finally, we will recommend to the Board that the requirement for a <br />drop structure be eliminated and that the depth of extraction be no greater than four (41 feet <br />below the elevation of the adjacent floodplain. <br />Please call me at 866-3567 if you have any questions. <br />Sincerely, <br />x Thomas A.
