Long <br />Division Director <br />Re: Conda/McKay, Revision Approval, Permit No. M-91-035, Revision No. AM-001 <br />Dear Mr. Stratton: <br />On April 26, 1995 the Divi=ion ;r~ Minerals and Geology condi*,ior.ally approved <br />the amendment application submitted to the Division on April 2'r, 1994, <br />addressing the addition of 425 acres, making the total acreage 707 acres. The <br />terms of the AM No. 001 approval by the Board are hereby incorporated into <br />Permit No. M-91-035. <br />The conditions of the Division approval are noted below. Please note that all <br />other provisions of Permit No. M-91-035 remain in full force and effect. <br />Stipulation No. O1 <br />WA[ WILL INSTALL FIVE PIEZOMETERS PRIOR TO ANY DISTURBANCE IN THE <br />AMENDED AREA TO DETERMINE GROUND WATER LEVELS. THESE WELLS WILL BE <br />USED TO DETERMINE THE ELEVATION OF THE GROUND WATER IN THE PROPOSED <br />PERMIT AREA. ONCE THE ELEVATIONS ARE DETERMINED, THE OPERATOR HAS <br />COMMITTED TO STAY THREE FEET ABOVE THE HIGHEST ELEVATION OF THE GROUND <br />WATER IN THE PROPOSED PERMIT AREA. LOCATIONS OF THE WELLS WILL BE <br />DETERMINED BY DMG, DOE, AND USFWS. THE PLACEMENT OF THE PIEZOMETER <br />MU`.iT BE COMPLETED AS SOON AS POSSIBLE. <br />St'pulation No. 02 <br />IN ACCORDANCE WITH THE AGREEMENT REACHED WITH THE COLORADO DIVISION OF <br />WILDLIFE AND USFWS, NO MINING WILL TAKE PLACE IN THE PROPOSED AREA <br />UNTIL MARCH 1997 IN ORDER TO ALLOW THE STUDY OF THE AREA TO BE <br />COMPLETED. <br />
