(MCC) submits this response to the Division's 2nd adequacy <br />review of 1 March 2005, for the Federal Lease Area of West Flatiron. The Division's comments aze <br />italicized and MCC's responses aze bolded. <br />Rule 2.03.6 (1) <br />1. Response accepted. <br />Rule 2.04.11 <br />2. Please add a statement in Exhibit 67 (Windy Gap Analysis) that speaks to any <br />changes in water depletion (or lack of changes) occurring with the mine expansion. <br />MCC's response: MCC is experiencing net increases of water being discharged to <br />the N. F. of the Gunnison River (see the 2003 AHR) of +306 acre-feet. As more <br />information and data have been obtained (since TR-79, April 1997) regarding the mine <br />water balance, Exhibit 67, completed by others, will need to have a major overhaul <br />because no depletions are being experienced. MCC proposes a complete re-write of <br />Exhibit 67, during permit renewal. <br />New Comment: Even though no additional depletions aze anticipated, this must be stated in <br />the text of Exhibit 67. The original comment stands. <br />MCC's response: MCC has made the statements of no additional depletions in <br />Exhibit 67, (attached). <br />
