Lung <br />I ll~~ ~ Division Director <br />RE: 08M Contact <br />I spoke with Rick Holbrook of the OSM/WSC regarding the incidental <br />boundary change for the O.C. Mine. I told him we are adding <br />approximately 8.5 acres that has already been mined. I told him <br />that O.C. had gotten the lease before they went through our <br />permitting process and for some reason this area was not included <br />under our permit. I told him that the mine is closed, the portals <br />are sealed, reclamation should be done this year and we are just <br />trying to clean up the file. I reminded him that he had spoken to <br />Dave Berry regarding this issue some time ago and he vaguely <br />remembered. I told him I called to make sure that it was <br />acceptable to do this as an incidental boundary change and a <br />federal mine plan approval would not be required. He said a <br />technical revision is fine and a federal mine plan approval would <br />not be necessary as they are not mining any additional coal. <br />cc: David Berry <br />
