In response to Mr. Ganzerla's letter of July 14, 2004, I am including a copy of his letters dated October 31, 2003 and November 6, 2003 to the Commissioners wherein he objected to the Map Amendment, together with a copy of my letter of November 13, 2003 in response to not only Mr. Ganzerla's letters, but also to Ms. Loe and Ms O'Brien letter of November 10, 2003 to the Commissioners regarding the Map Amendment. I have not enclosed all the enclosures that I sent to the Commissioners with my letter of November 13, 2003 as you have many of those survey plats. The photos that I sent were the only ones that I had. However, I am sure you are familiar with the ponds located in the Dalton Ranch Subdivision which are fed primarily with ground water. I am enclosing, however, a copy of the deed whereby the Dillon's received the "free" water out of the Reid Ditch. As I set forth in my letter of November 13, 2003, this conveyance constitutes none-third ownership in the "free" water. Wright Water Engineers of Durango, Colorado calculated that one-third of the "free" water in the Reid Ditch would amount to 3.9 c.f.s., as you can see from my letter of November 13, 2003. To that extent, I am enclosing a copy of the supplemental decree for the Reid Ditch together with a copy of the recorded agreement with Animas Valley Ditch and Water Company and Charles Idle.
