Box 1665 <br />Craig, CO 81626 <br /> <br />RE: Deakins Gravel Fit Expansion, Permit # M-2001-060, Revision No. CN-~ <br />Dear Mr. Baker, <br />OLORADf <br />I V I S I O N O <br />IN~RAL <br />EoLOc <br />Bill owem <br />Governor <br />Russell Geroge <br />Executive DinKtor <br />Ra,aia w. carrany <br />Division DireRw <br />Natural Resounx TnWee <br />On November 6, 2003 the Division of Minerals and Geology approved the Conversion application <br />submitted to the Division on September 10, 2003, addressing the following: <br />Convert the current I lOc permit for 9.99 acres to a 112c permit for 23.59 acres. <br />Among the terms of the conversion's approval is Stipulation No. 3, which states: <br />"T'he operator shall not mine any of the Phase 3 azea, as defined on the revised Exhibit C - <br />Mining Plan Map received by the Division on November 3, 2003 until the wetland issues are <br />resolved with the Corps of Engineers and the Division received a letter from the Corps stating <br />what the resolution is. At that time of the approval to begin mining on the Phase 3 area the <br />Division will reassess the financial warranty." <br />Per our phone conversation on May 12, 2006, the Division received the "Wetland Delineation Report for <br />the 3B-Enterprises Deakins Gravel Pit" on May 11, 2006 via Fed Ex. While we appreciate the opportunity <br />to review this additional information, the Division must reserve decision until the Corps has made their <br />assessment and provided us with sufficient documentation of their resolution to this matter. <br />As we have already received the approved bond amount, it appeazs that the above stipulation is the only <br />remaining issue of concern.
