Canany <br />Division Director <br />~=~ Natural Resource Trustee <br />1 to the 112c <br />DMG has completed review of your response to the preliminary adequacy review of the application fora 112c <br />permit for the Anderson Pit site. This response was submitted in the form of an Amendment (AM-01) to the <br />Anderson Pit application. The application, including the AM-01, cannot be approved until the following remaining <br />issues whose item numbers correspond to the November 22, 2005 adequacy review, are adequately addressed. <br />Please submit a response to the following issues as soon as possible, but no later than the decision due date set <br />for January 25, 2006. )f you cannot respond by January 25, 2006 please submit a written request for extension of <br />the decision date. If your response, or an extension request, are not received by January 25, 2006 this application <br />may be denied. <br />ADEQUACY ISSUES <br />14. Please either demonstrate how operations will be managed and what monitoring program will be conducted <br />to ensure groundwater levels do not fluctuate more than two feet at the location of large trees on the <br />Fredlund property adjacent to the proposed permit area, provide a commitment to not mine within 200 feet <br />of the large Fredlund trees until a demonstration is submitted indicating those trees will not be adversely <br />affected, submit evidence that those trees no longer exist, or provide a signed, notarized statement from <br />Marjorie Fredlund indicating that she will not hold the permittee or DMG liable for any adverse impacts to <br />those mature trees that may be affected by this mining operation. <br />37. The reclamation map has been revised to show that the two discharge pipes installed on the Hutchins <br />property remain after mining. The eastern pipe is to be used for irrigation of trees to be planted in that <br />buffer area and is most likely useful for that purpose after mining is complete. However, the sediment pond <br />discharge pipe (west pipe) does not appear to have any beneficial use after mining and will need to be <br />removed.
