Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety has finished the review of Amendment AM-Ol . <br />The final process prior to rendering a decision is the acceptance of the reclamation liability for the proposed <br />amendment. <br />Staff has calculated the Financial Liability for the amendment to be $443,731.00. This is based on the worst case <br />scenario of full reclamation of Pit #4, provided that concurrent reclamation continues as planned. A review of the <br />estimate supplied in Exhibit L shows two areas where the Division's estimate and United's differ. First is the <br />replacement of overburden within Pit #4. Staff looked at the costs using scrapers and a loader and trucks. The <br />difference in costs was negligible but time savings tipped towards using the scrapers. Staff is unsure of the basis <br />for the Exhibit numbers but used the same volumes in its calculations. The second area was in revegetation. The <br />estimate in Exhibit L does not include a secondary seeding cost. Given experience, the nature of the area and the <br />environment, staff feels a 50% replanting is not overly conservative. If the secondary task is removed, staff and <br />United are much closer. <br />Please review the enclosed estimate. If there are errors or clarifications that could change the estimate please <br />notify staff immediately. If United accepts the estimate, the Division needs written confirmation either by fax or <br />mail by 5:00, March 9`", 2007.
