Cottony Acting Division Director r~ / Re: 124th Estates Sand and Gravel Mine, Permit No. M-2001-085, Incomplete Notice for 112 Construction Materials Reclamation Permit Amendment Application Package, AM - 1 Dear Mr. Ewegen: On September 17, 2002, the Division of Minerals and Geology received your 112 Construction Materials Reclamation Permit Amendmant Application package for the 124th Estates Sand and Gravel Mine, Permit No. M- 2001-085. Preliminary review of the information received determined that the following items must be received before the Division will consider your application as being submitted and technical review can begin: APPLICATION FORM and Exhibits: The Applicant/operator or company name in the application form and throughout the exhibits received shows the name of your company as 124th Estates Partners, LLC. The Division cannot accept any documems received with that name. The Application and all of the exhibits must be changed to show the applicant/operatornome as Adams County RV Park, LLC dba 124th Estates Parhrers. EXHIBIT N -Source of Leval Rieht to Enter (Rule 6.4.141: You must provide the source of your legal right to -enter and initiate a mining operation on the affected land. This is the same requirement as Rule 6.3.7, which is: Provide a description of the basis for legal right of entry to the site and to conduct mining and reclamation, for the Owners of Record described in Subparagraph 1.6.2(1)(e)(i). This may be a copy of access lease, deed, abstract of title, or a current tax receipt. A signed statement by the Landowner and acknowledged by a Notary Public stating that the Operator/Applicant has legal right to enter and mine is also acceptable. EXHIBIT O -Proof of Mailine of Notices to County Commissioners and Soil Conservation District (Rule 6.4.17): Please submit proof of actual delivery or proof of mailing by Certified Mail, return receipt requested, of Notice of the Application to the local Board of County Commissioners and, if the mining operation is within the boundaries of a Soil Conservation District, to the Board of Supervisors of the Soil Conservation District. The copies of the receipts do not show that an item of mail was actually sent to the Adams Coumy Commissioners and the West Adams Conservation District.
