Cottony <br />Acting Division Director <br />r~ / <br />Re: 124th Estates Sand and Gravel Mine, Permit No. M-2001-085, Incomplete Notice for 112 <br />Construction Materials Reclamation Permit Amendment Application Package, AM - 1 <br />Dear Mr. Ewegen: <br />On September 17, 2002, the Division of Minerals and Geology received your 112 Construction Materials <br />Reclamation Permit Amendmant Application package for the 124th Estates Sand and Gravel Mine, Permit No. M- <br />2001-085. Preliminary review of the information received determined that the following items must be received <br />before the Division will consider your application as being submitted and technical review can begin: <br />APPLICATION FORM and Exhibits: The Applicant/operator or company name in the application <br />form and throughout the exhibits received shows the name of your company as 124th Estates <br />Partners, LLC. The Division cannot accept any documems received with that name. The Application and <br />all of the exhibits must be changed to show the applicant/operatornome as Adams County RV Park, LLC <br />dba 124th Estates Parhrers. <br />EXHIBIT N -Source of Leval Rieht to Enter (Rule 6.4.141: You must provide the source of your legal <br />right to -enter and initiate a mining operation on the affected land. This is the same requirement as <br />Rule 6.3.7, which is: <br />Provide a description of the basis for legal right of entry to the site and to conduct mining and <br />reclamation, for the Owners of Record described in Subparagraph 1.6.2(1)(e)(i). This may be a copy of <br />access lease, deed, abstract of title, or a current tax receipt. A signed statement by the Landowner and <br />acknowledged by a Notary Public stating that the Operator/Applicant has legal right to enter and mine is <br />also acceptable. <br />EXHIBIT O -Proof of Mailine of Notices to County Commissioners and Soil Conservation District <br />(Rule 6.4.17): Please submit proof of actual delivery or proof of mailing by Certified Mail, return receipt <br />requested, of Notice of the Application to the local Board of County Commissioners and, if the mining <br />operation is within the boundaries of a Soil Conservation District, to the Board of Supervisors of the Soil <br />Conservation District. The copies of the receipts do not show that an item of mail was actually sent to the <br />Adams Coumy Commissioners and the West Adams Conservation District. <br />
