Cattany Re: Notice ofPre-Hearing Conference and Formal Public Hearing, Aggregate Industries - WCR, Inc., Cooleyoivision Director Reservoir and Fulton Wildlife Area, Permit No. M-1999-034, Amendment Application No. 1 (AM-1) Natural Resource Trustee Dear Mr. Fleming: The Colorado Division of Minerals and Geology is reviewing an amendment application by Aggregate Industries - WCR, Inc. to add 50.21 acres to the above permit area. Because we have received objections to the application, we aze scheduling the matter for a fmal decision at a Forma] Public Hearing before the Colorado Mined Land Reclamation Boazd. In accordance with the Construction Materials Rules and Regulafions Section 2.7, the Division has scheduled aPre- Hearing Conference for May 27,2003. The conference will be held at 2:00 pm in room 623A, 1313 Sherman Street, Denver Colorado. Ms. Sandra Brown will preside as the Pre-Hearing Conference Officer. Tom Roan will be present as attorney for the Board. The purpose of the conference is to describe the Division's review process; explain the rights and responsibilities of parties; discuss and resolve issues to the extent possible; describe the Boazd Hearing process; determine the list of issues under the Board's jurisdiction and to determine who has demonstrated standing to be a party to the Formal Public Hearing. The Formal Public Hearing for Boazd Consideration of the Amendment Application will be conducted during the Boazd's June 24-25, 2003 meeting in Room 318, 1313 Sherman Sffeet Denver, Colorado, commencing at 10:00 a.m., or as soon thereafter as the matter can be heazd. Please review the enclosed inforrnafional memo, dated October 2, 2001 "Citizen Participation in the 112 Reclamation Permit Application Process, as revised October 19,2001.° Complete either of the forms on the last two pages, if one is applicable to you, and rettun it to me at the address on the letterhead or bring it to the Pre-Hearing Conference. On or before June 12, 2003, the Division will issue to the Board a Recommendation and Rationale for approval or denial of the amendment application.
