The revision revises the mining plan to add 9.8 acres to Lake #1, <br /> create a 4.3-acre Lake 43 and remove silt from the wash plant operation to enhance the lake shoreline <br /> and raise the elevation of Lake #1. The Division has a few comments regarding the revision that <br /> should be addressed by the operator. The decision due date is April 26, 2000. Please respond to the <br /> comments noted below prior to this date. <br /> 1. Rule 6.2.1(2)(b) requires that maps and exhibits be prepared and signed by a registered land <br /> surveyor, professional engineer, or other qualified person. Please have the maps and exhibits <br /> signed in accordance with the Rule. <br /> 2. TRO-003 included a revised Mining Plan Map depicting the proposed changes. The changes <br /> discussed in TR-003 are significant enough to also change the reclamation plan. Please <br /> revise the reclamation plan map depicting the addition of 9.8 acres to Lake #1, the 4.3-acre <br /> Lake 43 and the changes in shoreline configuration/elevation with addition of silt. Please <br /> also note that islands created will also need to be depicted on the map and meet the grading <br /> requirements of Rule 3.1.5(7). <br /> 3. The operator states that one or both gas lines will be relocated as a result of the change in <br /> mine plan. In accordance with Rule 6.4.19, for all structures that will be directly affected by <br /> mining, the operator will need to provide the Division with a notarized agreement between <br /> the operator and the owner of the gas lines that the operator has permission to mine through <br /> the structure and/or will provide compensation for any damage to the structure. Please <br /> provide the Division with the appropriate agreements/waivers with the owners of the two <br /> referenced gas lines. <br />
