Therefore, exposure of <br />ground water must not occur during or after mining operations. The applicant notes that the <br />existing mining operation intercepted small amounts of seepage water resulting from irrigation of <br />the crop lands south of the mine and storm runoff. Pursuant to 37-90-103(19), ground water is <br />any water not visible on the surface of the ground under natural conditions. Thus, the intercepted <br />seepage water is ground water. Pursuant to 37-90-137(11), a well permit, and plan for <br />augmentation or subsitute water supply plan, is required prior to any such exposure of ground <br />water which will occur after December 31, 1980. If the ground water was exposed prior to 1981, <br />the applicant must provide proof for our review. Note that even such proof is accepted by our <br />office, any increased out-of-priority depletions of the exposed ground water must be replaced to <br />the stream system. For example, evaporation from pond and/or channel surtaces causes <br />depletions to the stream system which may require replacement. <br />^ The proposed operation will consume ground water by: ^ evaporation, ^ dust control, ^ <br />reclamation, ^ water removed in the mined product, ^ processing, ^ other: <br />Prior to initiation of these uses of ground water, the applicant will need to obtain either a gravel pit <br />or other type of welt permit, as applicable. However, prior to obtaining a permit, an approved <br />water supply plan or decreed plan for augmentation is required in overappropriated areas. This <br />proposed pit is located in a critical stream system. <br />^ Prior to approving a well permit, the applicant must conduct a field inspection of the site and <br />document the locations of all wells within 600 feet of the permit area. The applicant must then <br />obtain a waiver of objection from all well owners with wells within 600 feet of the permit area or <br />request a hearing before the State Engineer. <br />® The proposed operation may have potential impact on existing water rights near the project <br />location. Please provide evidence that the proposed project will not alter or impact the historic <br />operation of existing water rights. <br />
