Governor <br /> 1590 W 12th Ave lames S.Lochhead <br /> Denver, CO 80204 Executive Director <br /> Michael S.Long <br /> RE: Deepe Farm Pit, Amendment Approval, Permit No. M-81-302, Revision No. AM-2 Division Director <br /> Dear Ms. Goettemoeller: <br /> On June 26, 1997, at a Formal Public Hearing, the Mined Land Reclamation Board approved the Amendment application <br /> submitted to the Division on March 6, 1997, addressing the following: <br /> Reduce number of lakes from 5 to 2 with total exposed acres of water reduced from 38.1 to 4.2 acres <br /> The terms of the Amendment No. 2 approved by the Division are hereby incorporated into Permit No. M-81-302. <br /> The conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M-81-302 <br /> remain in full force and effect. <br /> Stipulation No. Description <br /> 4.1 Approval of Amendment 002 does not include any changes to the perimeter berm configuration from <br /> that approved and depicted on the 1989 Amendment 001 Reclamation Plan Maps. <br /> 4.2 The Operator shall replace a minimum of 5.5 inches of topsoil on all reclaimed lands within the permit <br /> area. Further, the Operator shall provide a soil testing plan that would verify the replaced plant-growth <br /> media's ability to support the plant species to be established in reclamation. The soil sampling plan must <br /> be provided in the form of a revision to the permit and must by received by the Division of Minerals <br /> and Geology no later than 45 days after final action by the Mined Land Reclamation Board on <br /> Amendment 002 and approved no later than 45 days after initial submittal.
