Hampden Ave, Ste. 810 Natural Resource Trustee <br />Englewood, CO 80110 <br />Re: Lupton Lakes Resource, Permit No. M-2004-078, Technical Revision Approval, Revision No. TR-2 <br />Dear Mr. Campbell: <br />On November 18, 2005 the Division of Minerals and Geology approved the Technical Revision application submitted to <br />the Division on October 18, 2005, addressing the following: <br />Groundwater quality monitoring plan. <br />^Please note that the operator has proposed that in the event that the quality of groundwater at the point(s) of <br />compliance exceed maximum baseline levels by one standard of deviation for the parameter of interest and cause an <br />exceedance of a drinking water standard at a site or a specific well, [hen mitigative measures will be taken. As a point of <br />clarification, the"trigger" point that will be applied and enforced 63' the Division during on-going water quality <br />monitoring at the Lupton Lakes Resource is as follows: The Statewide groundwater standard or "MCL" if nvailable, or <br />the baseline (ambient) concentration for analytes where the baseline concentration exceeds the concentration of the <br />Statewide groundwater standard or `MCL "; or the baseline concentration for analytes (Phosphate-Total, Chlorinated <br />Pesticides (8081), Herbicides (8151), TEPC (8015 mod.), BTEX + MTBE (8021 mod.)) where there is no existing <br />Statewide groundwater standard. <br />The terms of the Technical Revision No. 2 approved by the Division are hereby incorporated into Permit No. M-2004- <br />078. All other conditions and requirements of Permit No. M-2004-078 remain in full force and effect.
