File No. M-1992-069 <br />83`d Joint Venture 112(c) Technical Revision TR-005 Second Adequacy Review <br />Dear Mr. Schenderlein, <br />The Division of Minerals and Geology ("Division") is in receipt of your request for an extension to the decision <br />date on the 83`d Joint Venture 112 (c) Technical Revision, TR-005, Application, File No. M-1992-069. The new <br />decision date is set for October 24, 2003. The Division is requesting further information regarding the TR <br />Application in order to determine whether the changes contained in the revision can be considered as a Technical <br />Revision to the permit, or whether the changes require submittal as an Amendment. Listed below are the items <br />needed, in addition to the items noted in the first adequacy review letter dated September 10, 2003, to make the <br />determination regarding the 83rd Joint Venture 112 (c) Technical Revision, TR-005, Application. The Division of <br />Minerals and Geology ("Division") is required to make a recommendation no later than October 24, 2003, <br />therefore, your response to the following adequacy review concerns should be submitted to the Division as soon <br />as possible. <br />1. The TR-005 Applicafion indicates that a channel will be excavated which will collect and deliver storm water <br />runoff to the groundwater lake located on the permit site. Please supply the dimensions, including the length, of <br />the proposed channel. <br />2. The Application indicates that an existing outflow channel exists at the site that would serve to deliver excess <br />runoff accumulated in the groundwater lake during a 100-year rain event to the Cache la Poudre River. Please <br />supply a downstream erosional analysis for this channel. <br />3. Please supply well information for all domestic and agricultural wells located within 600 feet of the site. <br />4. Please supply a surface water runoff water analysis for the water that will be directed into the groundwater <br />lake through the proposed channel. <br />5. Please supply a map depicting the adjacent landowners to the overflow channel and depicting the length and <br />path of the channel from the groundwater lake to the Cache la Poudre River. <br />Please be advised that the Aggregate Industries -WCR, Inc, 83rd Joint Ventura Pit, 112(c) Technical Revision <br />(TR-005) Application may be deemed inadequate, and the application may be denied on October 24, 2003 unless <br />the above mentioned adequacy review items are addressed to the satisfaction of the Division in a timely manner <br />allowing for adequate time to review the responses.
