Long. <br />Division Director <br />I have researched the San Luis Project file thoroughly to determine BMG's <br />monitoring requirements and history of reporting results to the Division. <br />Because the present Notice of Possible Violation is related to mill and <br />tailings facility operations, I limited the search to monitoring anj reporting <br />required since start up of the mill which was in January of 1991. <br />On December 20, 1990, Battle Mountain Gold submitted to the Division a request <br />for a technical revision to revise the monitoring schedule and moni:oring <br />parameters. The review process for that technical revision was not completed <br />by the Division and it became a revision to the permit automatically on <br />January 20, 1990. I have attached copies of the approved permit anti technical <br />revision schedules and parameters. The technical revision changed l:he surface <br />and ground water sampling schedule from monthly (May-June) and quarterly <br />(October, January, April and July) to a quarterly schedule. New analytical <br />parameters were added to two quarterly monitoring periods. The revised <br />sampling during the remaining two quarters includes a reduced suite of <br />parameters which eliminated sampling in these quarters for total cyanide. <br />A document titled Monitoring Requirement Summary submitted to the Division <br />January 22, 1990 states that "chemical analysis of the collection pond seepage <br />on a quarterly basis for the parameters identified in Table G 1-2 of the <br />approved permit will be performed. In addition, the leak detection system of <br />the collection pond will be monitored for any water weekly during initial six <br />month start-up and monthly thereafter." There is no commitment to report <br />this data to the Division. Also, this document states that "data collected as <br />part of the tailings monitoring program will be compiled into an annul report <br />for submittal to the MLRD." <br />Battle Mountain Gold stated in their permit and adequacy responses that they <br />would also monitor settlement of the tailings embankment free water pool <br />volumes, deposited tailings densities, and the quantity and quality of <br />solution draining to the collection pond from the tailings disposal facility. <br />However, I did not find a commitment by BMG to submit these monitoring results <br />to the Division. <br />
