Collins, Mine Manager - (720) 565-3448 <br />Section 12, Twp 1 North, Rng. 72 West, 6th P.M., Boulder County <br />CONDITIONS FOR APPROVAL <br />® The proposed operation does not anticipate exposing groundwater. Therefore, exposure of <br />ground water must not occur during or after mining operations. The purpose of this <br />amendment is to incorporate and modify the existing permit area boundary. The total acreage <br />of the amended permit area would increase by 6.14 acres to a total of 9.83 acres. The <br />proposed modified permit area is generally divided into three areas as follows: Cash Mine <br />Area will be enlarge from 2.26 acres to 2.76 acres, Who Do Mine Area will be enlarge from <br />1.42 acres to 2.42 acres, and Mount Royale Area represent an addition the existing permit <br />M1983-141, which encompasses a total of 4.65 acres. <br />® Based on the information provided it is not clear if the proposed mining operation will consume <br />ground water. If ground water is consumed by mining operation an approved water supply <br />plan or decreed plan for augmentation may be required, unless the applicant can demonstrate <br />that the water in the mine is non-tributary. <br />^ Prior to approving a well permit, the applicant must conduct a field inspection of the site and <br />document the locations of all wells within 600 feet of the permit area. The applicant must then <br />obtain a waiver of objection from all well owners with wells within 600 feet of the permit area or <br />request a hearing before the State Engineer. <br />^ The proposed operation may have potential impact on existing water rights near the project <br />location. Applicant needs to demonstrate that the proposed project will not alter or impact the <br />historic operation of existing water rights. <br />® The applicant has indicated plans to construct and operate a well in conjunction with the <br />Mount Royalle No. 1 Adit. A commercial exempt permit may be available for the site for <br />drinking and sanitary facilities inside a commercial business. Water from this type of well shall <br />not be used for lawn or landscape irrigation or for any other purposes outside the business <br />building structure. The annual amount of ground water to be diverted is limited to the pumping <br />of 1/3 acre-foot (108,600 gallons) per year (in any 12-month period). If the proposed well <br />would not qualify under the exempt provision prior to obtaining a permit to construct the <br />proposed well the applicant may be required, to obtain an approved water supply plan or <br />decreed plan for augmentation.
