Cattany <br />Division Director <br />Angola, Indiana 46703 tural Resource Trustee <br />N <br /> ~ <br />RE: Pending Amendment Application, James Van Ella, Gold Basin Mine, Permit M-1992- 045. <br />Deaz Ms. Van Ella: <br />The Division of Minerals and Geology (DMG) received your email regazding definition of previously <br />disturbed areas on and around the Gold Basin Mine property. Your email refers to working on a <br />Conversion Application. However, I believe that you are actually working on an Amendment to an <br />existing 110-Limited Impact Permit. If this is incorrect, please let us know as soon as possible. <br />In your email you make references to pre-law and/or pre-Gold Basin Mine permit disturbance asserting <br />that Gold Basin should not be responsible for such disturbance. You mentioned that there should be some <br />type of record from our Division stafing that the pre-mining disturbance is well known and documented. I1 <br />is up to the operator to state and document what has been disturbed pre-law or prior to permitting a site. <br />Prior to approving the amendment application, the Division will determine whether to accept this <br />designation of pre-law or pre-permit disturbance. If such disturbance is not pre-law orpre-permit and has <br />occurred as a result of activities conducted under Permit M-1992-045, the operator is required to reclaim <br />such disturbance according to the agreed upon reclamation plan. In addition, if the operator disturbs apre- <br />law area or disturbs apre-permit azea, then reclamafion will be required. <br />Therefore, please define disturbance areas on the mine plan map of the amended and expanded permit area <br />that you assert aze not your responsibility.
