~~ ~ DEPARTMENT OF THE ARMY
I COAPS OF ENGINEERS, OMAHA DISTRICT
DENVER REGULATORY OFFICE, 9307 S. Wadsworth Boulevard
. LITTLETON, COLORP.DO 80128-6901
October 5, Zoos RECEIVED
Ms. Erica Crosby QCT ~'~
Division of Minerals and Geology
Department of Natural Resources Uivlaion of Minerals and Geology
1313 Sherman St., Room 215 '
Denver, CO 80203
1tE: Jake Kaufman & Sons, Inc., Wagner/Kauffman Pit #3, Permit No. M-1999-069
Corps File No. 199880085
Dear Ms. Crosby:
Reference is made to the above-mentioned project located in Section 16, TSN, R68W, Larimer
County, Colorado. Please see the attached copy of my October 22, 2001 letter to Frank Kauffman.
This project has been reviewed in accordance with Section 404 of the Clean Water Act under
which the U.S. Army Corps of Engineers regulates the discharge of dredged and fill material, and any
excavation activity associated with a dredge and fill project in waters of the United States. Waters of the
U.S. includes ephemeral, intermittent and perennial screams, their surface connected wetlands and
adjacent wetlands, certain lakes, ponds, drainage ditches and irrigation ditches that have a nexus to
interstate commerce.
Based on the information provided a Department of the Army (DA) Permit will not be required
for work at this site. Although a DA Permit will not be required for the project, this does not eliminate
the requirement that other applicable federal, state, and local permits be obtained as needed.
If there are any questions call Mr. Terry McKee at (303) 979-4120 and reference Corps File
No. 199880085.
o:..,.o..a..
tm
