Your request is based on the anticipated scheduling of a well permit hearing in September at the <br />Office of the State Engineer. Due to objections received during the public comment period, the Division will be <br />making a "recommendation" on your amendment application on October 13, 2004. Therefore, we request that <br />you submit a response for all outstanding adequacy concerns no later than October 1, 2004 in order to have <br />adequate time for review. The Division will present its recommendation to the Mine Land Reclamation Boazd <br />during a Formal Public Hearing scheduled for October 27-28, 2004. Ultimately, the Board will issue a decision <br />on the amendment application and we anticipate this decision at the close of the hearing. It is important to note <br />that a decision must be made within 365 days of your amendment application submittal, November 13, 2003. <br />And, as we have noted in our previous May 24, 2004 correspondence, the amendment application is part o£ <br />corrective actions requested by the Division in its January 3, 2003 inspecfion report. <br />Just as a reminder, all parties must exchange witness and exhibits information no later than 5:00 p.m. no less than <br />fifteen working days prior to the Formal Board Hearing, ie: October 5, 2004. <br />Please call me at (303} 866-3567 if you have any quesrions. <br />Sincerely, <br />Thomas A.
