MEMO <br />~~ <br />Date: October 28, 2003 !~ <br />To: Colorado Mined Land Reclamation Boazd t/ <br />From: Larry Oyyehler~Environmental Protection Specialist <br />Re: Item No. A; Oct. 29-30, 2003 MLRB meeting agenda, Aggregate Industries - WCR, <br />Inc., Cooley Reservoir and Fulton Wildlife Area, Permit No. M-1999-034 / <br />On June 25, 2003, the Boazd conducted a hearing on Aggregate Industries' application <br />for Amendment No. 1 to permit No. M-1999-034. The Division recommended approval <br />of the application with one condition. The Boazd added a second condition and approved <br />the amendment. The second condition is as follows. <br />"Aggregate Industries shall sample Kazen Topper's domestic water supply well, permit <br />No. 2455, for DIMP prior to and after de-watering begins, and shall submit the results <br />to the Division and to Ms. Topper within 30 days of the sampling." <br />Kazen Topper, represented by her brother, was the sole objector at the hearing. Ms. <br />Topper has requested that the well to be monitored be changed to her irrigation well, <br />permit No. 32883. Aggregate Industries has indicated, through their consultant, that the <br />change is acceptable to them. <br />The Division is requesting that the Board change Condition No. 2, by removing the <br />words "domestic water supply well, permit No. 2455" and replace them with "irrigation <br />well, pemut No. 32883: ' <br />
