We note for the record that Mr. Todd Sargent failed to meet the deadline for party status by filing a party status request on December 31, 1989. Mr. Neal Cohen, on Behalf of the Costilla County Committee for Environmental. Soundness ("CCCES"), filed CCCES' party status request ten days after the deadline on January 8, 19890. We understand that these parties received the Preheating Order. Mr. Cohen participated in the negotiation of the Preheating Order following the December Board Meeting. Therefore, both knew or should have known of tY.ie deadline for party status requests. Battlement Mountain has submitted copies of its adequacy responses and subsequent supplemental responses to all objectors including those who failed to meet the party status deadline. These responses were submitted pursuant to Battle Mountain's obligations in the Preheating Order. In transmitting these copies to CCCES, and Mr. Sargent, Battle Mountain specifically reserved the right to challenge their status as parties in this proceeding. Battle Mountain hereby registers its formal objection to the party
