Box 307 <br />San Luis, Colorado 81152 <br />Re: Battle Mountain Resources, Inc., San Luis Project <br />Dear Ms. Lucero: <br />Thank you for your correspondence dated November 29, 1989, regarding the <br />above undertaking requiring a permit from the Colorado Mined Laid <br />Reclamation Division and involving open pit mining, a heap leac~~ facility <br />and a milling facility. We appreciate your concern about the effects of <br />this project on the environment in your area and your interest in the <br />preservation of historic properties and long-range planning. <br />Please note that our September 20, 1989, correspondence to Ann :3aldridge of <br />SCephen, Robertston & Kirsten was in response to a request for .i search of <br />our records for known historical and archaeological sites and surveys in <br />the locations listed in that correspondence. That response doe:; not <br />constitute a comment on the effects of the undertaking. <br />Since there is no federal involvement in the proposed work but +:here is <br />state agency involvement, we can only comment pursuant to the S+:ate <br />Register of Historic Places Act (CRS 24-80.1-101-108) concerning; the <br />effects of a state agency action on a property nominated to or :accepted by <br />the State Register of Historic Properties. That act does not gave the <br />Colorado Historical Society the authority to require that a sur~~ey be <br />conducted. In addition it is not the policy of our office to conduct <br />surveys of any project areas since we lack the resources to do so. <br />Based upon the information provided, it is our opinion that the Corazon de <br />San Luis de la Culebra Historic District, which is listed in the: State <br />Register, is not located within the area of the proposed action. Therefore <br />we have concluded that the undertaking will have no effect on ttie <br />historical and architectural character that qualified the prope7~ty for <br />entry into the State Register. <br />`REr'EIVED <br />oEC z'r 1989 <br />
