The acreage of the processing site on Exhibit C has been changed to 22.2 to reflect <br />the correct size of the area. <br />2. The area of the settling pond is 4.8 acres. At the present time, we are planning allow <br />the pond to completely fill with silt and then seed the area with the approved seed <br />mix. Another option under consideration is to leave the area as a wetlands. <br />3. Current Phase V (new Phase II) will not be mined until the design of the inlet <br />structure has been approved by DMG. We have retained the firm of Western Water <br />& Land Inc. to design the inlet structure. I do not believe that the design of the inlet <br />can be completed the by the April 1, 2006 deadline. A Rider to the financial <br />warranty was submitted to DMG which covers the cost of the inlet construction. <br />4. A revised Exhibit F, Reclamation Plan Map is enclosed which shows the location of <br />the 0.2 acre wetlands bench around the island. <br />5. The reduction in acreage of current Phase V I (proposed Phase V) is the result of <br />moving the mining setback to i 50 feet from the ordinary high water line as required <br />by the 404 Permit and not the elimination of the inlet structure. <br />If you have an questions or need additional information please contact me. <br />Sincerel~~~~ <br />~e" <br />Edward J Settle <br />
