Watcher <br />291 7 L50 ROad Executive Director <br />Hotchkiss, CO 61419 Ronald w. canany <br />Acting Division Director <br />Re: High Mesa Gravel Pit, Permit No. M-2000-067, Technica/ Revision fTR-02/ Approve/ Reconsideration. <br />Dear Mr. Crane: <br />Staff received a telephone call from Beavers Construction, the permitee, on May 8t", 2003 concerning the <br />above referenced TR-02. Mr. Beavers stated that he did not authorize Crane Associates to submit the above <br />referenced TR on his behalf. A letter to this Office, received today by fax, documents Mr. Beavers <br />statements. (enclosed) There are issues being discussed in a business deal for which the Division has no <br />right or wish to be involved. Because Crane Associates did not have the authorization to act on behalf of the <br />operator, staff's decision to approve the Technical Revision is rescinded. If this Office does not receive a <br />signed, notarized letter from Beavers Construction, Inc. authorizing Crane Associates to be its agent for this <br />TR, as submitted, by noon on May 30th, 2003 staff may deny the requested changes. Be advised that <br />without the authorization there is no appeal process for denial of the request because the permitee or his <br />authorized agent are the only persons whom may submit changes to his/her permit. The other option for <br />staff will be to stipulate the TR will not become active unless the recalculated Financial Warranty is accepted <br />by the Division. This enables the operator to have the final say in whether to go forward or not. No refund <br />of fees would be forth coming as staff spent considerable time on short notice at Crane Associates behest <br />on the TR under possible false pretense. <br />Further, in the future, a~ requested permit actions undertaken by Crane Associates will require the above <br />referenced signed, notarized letter stating that the consultant has authority to act on behalf of that individual <br />upon submittal to the Division. This is a requirement from the main office in Denver for all consultants that <br />must be enforced by the field offices as well. <br />This Field Office wants to make clear that at this time its displeasure with the way this TR has been <br />submitted and the inference that all parties were in agreement and in a hurry.
