Walther

FROM: Allen Sorenson Executive Director
Ronald W. Cottony
Division Director
MESSAGE TO RECIPIENT NaNral Resource Trustee
Anne,
The pre-hearing conference for Amendment AM-04 is scheduled for Tuesday, May 20 at 1:30 in the commissioner's
meeting room at the Grand County Courthouse. Included with this fax is explanatory information that we send to
parties prior to pre-hearing conferences. Tomorrow, I will fax you the Division of Minerals and Geology summary of
the status of the Henderson Amendment Application to describe what will be required of Henderson if the amendment
is adopted, particularly as it relates to tree and shrub planting and the potential future consideration of a wet cover for
tailing impoundment reclamation. I think the summary will assist all parties in knowing just what approval of the
amendment as it now stands will do and will not do in terms of mined land reclamation requirements. Also included
with this fax are cover sheets that I sent to Grand County and to the Forest Service when I sent them these same
documents.
If it is decided to proceed to a hearing before the Mined Land Reclamation Board, all parties are entitled to a 30-day
notice of the hearing. Depending on what happens at the pre-hearing conference, I have asked Grand County and the
Forest Service to consider whether they would prefer to waive the notice so we can have the hearing at the May 28-29
meeting of the Mined Land Reclamation Board. Henderson would also have to provide such a waiver in writing.
If you have any questions, call my direct line at 303/866-4063.
Thanks, Allen
DATE: 5-13-03 NUMBER OF PAGES (including cover sheets): 22
PROGRAM: MINS.
