On September 9, 2004 the Division of Minerals and Geology approved the Technical Revision application submitted to
the Division on August 11, 2004, addressing the following: Revise the mine and reclamation plan to include 2 phases of
mining and reclamation. The amount offnancial warranty required for Phase 1 is $186,000.00. The amount offinancial
warranty required for Phase 2 is $197,900.00. (see attached reclamation cost estimates). The terms of the Technical
Revision No. 1 approved by the Division aze hereby incorporated into Pt:rmit No. M-2000-156. All other conditions and
requirements of Pernlit No. M-2000-156 remain in full force and effect.
The Division currently holds a financial warranty of $759,109.00. Upon receipt of a financial warranty in the amount of
$186,000 for Phase 1, the Division will return the existing warranty of $759,109. Also, a financial warranty of $197,900
will be required approximately 60 days prior to disturbance of the Phase 2 azea.
