In the attachment, Douglas C. MacLazen, a <br />registered professional engineer with W.W. Wheeler and Associates, certifies that the pipeline passed <br />hydrostatic testing on November 8, 2003 and that high pressure joints inspected by ultrasonic methods <br />were found to be free of defects. A few minor items remain to be constructed (culverts, retaining walls, <br />etc.), but these items are not necessary to the neaz term safe operation of the pipeline, and construction <br />of these items will not impact the safe operation of the pipeline. <br />The certification provided meets the requirements of Rule 7.3 of the Mineral Rules and Regulations of <br />the Mined Land Reclamation Boazd. In accordance with Rules 7.3.1(5) and 7.3.2(3), the Division of <br />Minerals and Geology (DMG) hereby accepts the certification of the Storke Water Return System. <br />With this acceptance, Climax may put the new pipeline into service. As a condition of this acceptance, <br />a copy of the final project report including as-builts and all testing data must be provided to DMG <br />before January 1, 2003. If any problems develop with the meeting of this deadline, please contact me in <br />advance.
