Battle Mountain Resources <br />Inc. is a subsidiary of Battle Mountain Gold Company. Battle Mountain Resources [nc. holds a <br />permit issued by the Mined Land Reclamation Board for a gold mining operation in San Luis, <br />Colorado. The Division requests that Battle Mountain Resources, Inc. provide the following <br />information about the corporate statuses of Battle Mountain Gold Company and Battle Mountain <br />Resources, Inc. by February 26, 2001: <br />Please state whether Battle Mountain Gold Company will continue to exi.;t as a <br />corporation in good standing in Colorado. <br />2. Please state whether Battle Mountain Resources, Inc. will continue to exist as a <br />corporation in good standing in Colorado. Please also state how, if at all, Battle Mo~intain <br />Resources, Inc., will be affected by Newmont Mining Corporation's acquisition of E~attle <br />Mountain Gold Company and its subsidiaries- and whether thece is anything that cor:lpromises <br />Battle Ivfountain Resources, Inc.'s ability to hold the permit or reclaim its mine site I~ursuant to <br />permit and regulatory requirements. <br />Please note that the Colorado Mined Land Reclamation Act and the rules promulgated <br />thereunder require that a valid, existing entity be the holder of a permit. If Battle Mc untain <br />Resources, Inc. has ceased its corporate existence, or intends to cease its existence, the Division <br />will issue a notice of violation for failure to have a valid, existing entity holding the hermit.
