In accordance with numerous discussions with
your office, the landowners and the leaseholder Lafarge hereby requests that a technical revision
to the above referenced permit be granted.
All parties have agreed that the origination of the mining limits based merely on a contour
elevation was not well thought out. While the original operator sought to identify the bottom of the
gravel deposit in this fashion, the process gave little credence to subsequent mining operations or
the required end-use of pastureland. That being said, the issues involved in the disturbance of
areas outside the existing mining limits are really twofold.
The first is the backfilling of the area referred as the gulch or wash outside the mining limits.
While Lafarge accepts the responsibility of placing the material along the slopes of the wash, it
was done under the direction of the landowner Mr. Cugnini. His intent is and remains to
completely fill this gulch to provide more suitable land for grazing upon cessation of mining.
The second issue is the location of the access road at the head of this gulch. The road was
established prior to Lafarge's involvement in the pit and was located just outside the mining
boundary. While it would not be difficult to reclaim this road alignment, to relocate the road within
the boundary would require the deforestation and excavation of undisturbed land. No parties
involved wish to disturb this area unnecessarily.
Lafarge has taken steps to stabilize and protect the disturbed areas in question as well as the
mine site itself. The company is further prepared to reclaim the slope of the gulch and the
roadway should that be necessary. It is the intent of the landowner, however, that the gulch be
backfilled to better suit post mining uses. Therefore, Lafarge requests that these issues be
considered in its request.
Please contact me with any questions or concerns you or your office might have.
Sincerely, /`
Matt R.
