Long <br />TO: Mike Long orvision Dneaor <br />FROM: toe Dudash ~~ <br />RE: Extension of Abatement Due Dates, NOV C-95-017, Trapper Mine, <br />Permit No. C-81-010, Trapper Mining, Inc. <br />Trapper Mine has requested an extension for each of the two abatement step deadlines <br />for NOV C-95-017. It is only the deadline extension for the second abatement step <br />which would require a greater than 90 day abatement time, namely, 154 days. <br />This NOV was issued as a result of a 2.5 acre slide that had occurred in a reclaimed <br />section of the mine. The first abatement step was to submit a technical revision by <br />July 11, 1995, detailing a remediation plan based on field and laboratory studies of the <br />slide. The second abatement step was to implement the remediation plan outlined in <br />Step No. 1 by August 28, 1995. <br />However, due to very wet ground conditions, Trapper believes that they will have to <br />wait until mid or late July to start field sampling operations. They are requesting that <br />abatement step 1 be extended from July 11 to August 28. This appears to be a <br />reasonable request. The ground is very wet and bringing in heavy equipment to dig test <br />pits would probably tear up the ground and, perhaps, pose safety problems. After the <br />field data is obtained, laboratory analyses would be required, followed by the design, <br />submittal, and approval of the remediation plan. <br />Because August 28 is the 90th day, the step 2 abatement deadline would need to be <br />extended beyond the 90th day. Trapper has requested that the step 2 abatement <br />deadline be extended to October 31 or to at least 30 days past the approval of the <br />technical revision, whichever is later. The Division believes that an extension to <br />October 31 is acceptable. Any later and winter conditions may become a problem. <br />Abatement steps of greater than 90 days due to climatic conditions are allowed under <br />Rule 5.03.2(2)(c)(iv). <br />Attach men t M:\OSSamm~nblmemo.jjd <br />
