Box 89 <br />Waisenburg, CO S1C81 <br />RE: Response to Inquiry about <br />production at Rocky flat <br />MLRD File No. M-82--129. <br />Dear Dr. Davis: <br />mining, reclamation plan, and recent <br />Gravel Pit (Goemmer Pit), Huerfano County. <br />Otto L. Goemmer, permittee. <br />Regarding your inquiry of 10/17/91 to Mr. Dan Hernandez of this office, I <br />have collected the following information. <br />The Mined Land Reclamation Division (MLRD) of the Department of Natural <br />Resources approved a Limited Impact (110) Permit for this operation on <br />August 5, 1982. MLRD hers received Annual Reports for this operation since <br />that time, and the most recent was submitted August 19, 1991. Thus, the <br />permit is still active. <br />For your information, the 110 Permit mentioned above covers mining over <br />areas smaller than 10 acres (including roads, Stockpiles, and any other <br />surface facilities) over the life of the mine. Under this permit the <br />operator can extract no more than 70,000 tons of material, including <br />overburden, per year. The most recent annual report indicates that 58,000 <br />tons of material were used on county and state highways from material <br />crushed over the past 2 years, and that 55,000 tons of material were <br />crushed in the most recent annual period. <br />The "Application for Special Use Permit-Strip Mining" which was issued by <br />the Huerfano County Planning Commission and which is a part of the MLRD <br />Permit indicates the estimated duration of operation is 12 years. Please <br />note: our permit is a "Life-of-Mine" permit; even though an estimation of <br />the duration of operation is required in the permit, this estimate is not <br />binding. Thus, the operators are permitted to operate indefinitely, <br />provided they submit annual reports and fees, and conduct operations in <br />accordance with the Mined Land Reclamation Act. This does not mean <br />necessarily that the County permit works in the same way, but you will need <br />to check with the county to answer that question. <br />
