SHELTON, Director <br />September 2, 1987 <br />Mr. Joe Caprio <br />La Plata Coal Corporation <br />3701 County Road 120 <br />Hesperus, Colorado 81326 <br />Re: La Plata No. 1 Mine - Legal Right of Entry - File No. C-87-072 <br />The Bureau of Land Management (BLM) has conducted an investigation of lands in <br />the Hay Gulch area, due to objections raised during National King Coal's <br />application for a Logical Mining Unit (LMU): During this review, the BLM <br />notified the Division of a discrepancy they have found with respect to your <br />permit application. <br />Exhibit 1 of your permit application presents the Legal right to enter <br />documents for the La Plata No. 1 Mine. A "Coal Lease" executed on <br />December 26, 1986 between Tony and Barbara Sarver and La Plata Coal <br />Corporation specifies ownership of coal and right to mine coal for the N1/2 <br />SW1/4 Section 28 T35N R11W NMPM. As addressed in the enclosed document, the <br />United States of America through the 8LM specify they hold reservation to the <br />coat in the N1/2 SW1/4 Section 28 T35N R11W NMPM. <br />The Division must be assured of the legal right of entry to the surface (for <br />the facilities) and to the coal. It is necessary for La Plata Coal <br />Corporation to submit the most recent legal documents for the La Plata No. 1 <br />Mine with a verifiable explanation for all of the areas.
