Long <br />D~mslon Direanr <br />On Augus[ 3, 1998, the Division of Minerals and Geology received the map depicting the <br />disturbance associated with the Gardner Gravel Pit, Permit No. M-79-034. The map was <br />required as a result of the June 25, 1998 inspection, and based on that map the Division found the <br />following: <br />Approximately 7 acres had been disturbed outside of the present permit boundaries of Permit No. <br />M-79-034. Based on this map, the operator failed to first obtain a reclamation permit prior to <br />engaging in a new operation or the operator failed to protect areas outside of the affected land <br />from slides or damage during the mining and reclamation opera ions. We believe this is in <br />violation of 34-32.5-109(1) or 34-32.5-116(4)(1) of the Colorado Revised Statutes, commonly <br />referred to as the Colorado Land Reclamation Act for the Extraction of Construction Materials. <br />Therefore, we have reason to believe that a violation exists to Permit Number M-79-034 and to <br />the Law, and have scheduled this matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the September 23-24, 1998 Board meeting for <br />consideration of possible violation. The hearing will be held in Room 318 of 1313 Sherman <br />Street, Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter as the matter can be <br />considered. At that hearing you will have the opportunity to be represented and heard. It wilt be <br />reiterated that there is reason to believe that you are in violation of the provisions noted above. If <br />you wish to have this matter considered at the August 26-27, 1998 Board meeting to be held at <br />the Holiday Inn in Craig, Co., a request must be submitted in writing by the operator waiving the <br />30-day notification of the Board hearing. <br />~ III Iiillllllllll III <br />STATE OF COLORADO <br />
