On November 22, 1993, we responded to Part 2 of the <br />TDN. With this letter, we would like to respond to Part 1 of the TDN concerning <br />Colorado Notice of Violation No. C-93-042, and update our response to Part 2 of the <br />TDN concerning Colorado Notice of Violation No. C-93-044. <br />Notice of Violation C-93-042 was issued on April 9, 1993 for failure to follow the <br />approved hydrologic monitoring plan. Basin Resources responded to the NOV by <br />stating that, at the time of the inspection, company personnel familiar with the <br />location of the hydrology records were not present. As a result, records that were <br />at the mine site were not found. <br />The Division granted the company's request to submit to the Division the data cited <br />in the NOV. An extension to December 10, 1993 was granted for submittal of this <br />data (enclosed). On November 22, 23 and 25, 1993 Basin Resources submitted most of <br />the hydrologic data. Because the remaining data was either lost or never recorded, <br />the Division modified NOV C-93-042, on November 26, 1993, to include only that data <br />that ie unrecoverable. <br />In addition, Basin Resources has corrected problems with their contract water <br />analyses laboratory in order to ensure that all required parameters are analyzed. <br />Therefore, the Division believes that Basin Resources has made the necessary <br />modifications to their hydrologic monitoring program ae required to abate <br />NOV C-93-042. On November 26, 1993 the Division terminated NOV C-93-042, thereby <br />addressing the concerns of Part 1 of TDN X-93-020-190-06 TV2. <br />The Division also believes that Part 2 of TDN X-93-020-190-06 TV2 is in the process <br />of being satisfied. The operator will, very shortly, be finished with seeding, <br />mulching and netting the appropriate road embankments, well within the fall 1993 <br />seeding season, as outlined in NOV C-93-044. The Division will conduct an <br />inspection by Wednesday, December 1, 1993 to check for compliance with the required <br />abatement. <br />The Division believes that these actions address the concerns of TDN X-93-020-190-06 <br />TV2.
