The <br />violation alleges failure .to submit to the Division an Annual <br />Reclamation Report for 1996, and failure to complete Year 2 <br />vegetation monitoring as required by the permit. <br />The facts supporting EFMC's request to vacate the violation, <br />referencing both items mentioned in the violation, are explained <br />below in detail. <br />1. Failure to submit the 1996 Annual Reclamation Report <br />Submittal of the Annual Reclamation Report was an administrative <br />oversight by EFMC. The DMG discussed submittal of the report during <br />a telephone conversation with EFMC the week of October 6. EFMC <br />compiled the report on October 10, then mailed the report to the <br />Division on October 15. <br />Although submittal of the Annual Reclamation Report was past the <br />deadline set forth in Rules, EFMC did not intentionally withhold <br />information from the Division that might be used to evaluate the <br />progress of reclamation at the site. The only substantial <br />information presented in the report, which may also be found in the <br />DMG's inspection reports, is EFMC's documentation of reseeding <br />approximately 3 acres of the reclaimed mine site during 1996. <br />
