In the N.O.V., we indicated that Rule 2,03.9 had been violated,
and Rule 5.03,2 was added to substantiate our authority to issue a violation.
The specific part of Rule 2.03.9, which we believed to have been violated
reads as follows:
Rule 2.03.9(2):
"The policy shall be maintained in full force during the life of
the permit and any renewal thereof, inc]uding completion of all
reclamation operations under Rule No. 4."
The operator has submitted apparent proof which indicates that insurance
coverage did not lapse. Since the policy was apparently maintained in full
force, no violation occurred.
DAB/eke
0175F
