This <br />NOV involves failure to construct a coal refuse pile according to the Regulations and the approved <br />design. Because Jim Pendleton is involved in this NOV, he can not be the assessment conference <br />officer. <br />The request for an assessment conference was received at the Division on May 24, 1999. According to <br />the Rules, the assessment conference should be held within 30 days of receipt of the request. <br />Therefore, the assessment conference should be held before June 23, 1999. <br />Larry Routten and l will be representing the Division. Jim Pendleton will not be at the assessment <br />conference, but will be in the office and available if the issues get too technical. In asking Larry and <br />Jim what their schedules are, it would appeaz that June 1 ~, 16, 17 or 18 would be a mutually agreeable <br />time. If this isn't convenient for you, we can work something else out. I have not discussed the timing <br />of the assessment conference with the operator yet. <br />Please let me know when you can conduct the assessment conference.
